DCF Investigations in Massachusetts
Generally speaking, DCF investigations are initiated when the department receives and screens-in a report of suspected abuse and/or neglect. The Massachusetts DCF will then assign a social worker, also referred to as a “51 B Investigator,” to the case. If the social worker finds that there is reasonable cause to believe that abuse/neglect has occurred, DCF will send a letter notifying the parent/guardian that he or she has 30 days to request a Fair Hearing to appeal the determination. Following a Fair Hearing, families may be assigned an assessment worker.
The consequences of a DCF investigations can be severe for families - potentially resulting in criminal charges; jail time; removal of your children from your home/custody; limited or no visitation with your children; and termination of your rights as a parent/guardian. For this reason, it is very important for parents to obtain an experienced DCF Investigation Attorney as soon as possible.
