DCF Investigations in Massachusetts

The Massachusetts Department of Children and Families (DCF), formerly known as the Department of Social Services (DSS), is the state agency tasked with responding to reports of child neglect and abuse in MA. If you are a parent who has been charged with a criminal offense or accused of abuse/neglect, DCF may have commenced an investigation of the situation to determine whether to initiate or continue DCF involvement with your family.

Generally speaking, DCF investigations are initiated when the department receives and screens-in a report of suspected abuse and/or neglect.  The Massachusetts DCF will then assign a social worker, also referred to as a “51 B Investigator,” to the case.  If the social worker finds that there is reasonable cause to believe that abuse/neglect has occurred, DCF will send a letter notifying the parent/guardian that he or she has 30 days to request a Fair Hearing to appeal the determination.  Following a Fair Hearing, families may be assigned an assessment worker.

The consequences of a DCF investigations can be severe for families - potentially resulting in criminal charges; jail time; removal of your children from your home/custody; limited or no visitation with your children; and termination of your rights as a parent/guardian.  For this reason, it is very important for parents to obtain an experienced DCF Investigation Attorney as soon as possible.
