Aggravated Assault & Battery

The crime of aggravated assault and battery is governed by Massachusetts General Laws Chapter 265 Section 13A. In order for someone to be convicted of aggravated assault and battery, the Commonwealth must prove beyond a reasonable doubt that the individual committed an assault or an assault and battery that:

  • Caused serious bodily injury to the victim
  • Or the individual knew or had reason to know that the victim was pregnant
  • Or the individual knew that the victim had a restraining order out against him or her at the time of the incident

Aggravated assault and battery is a more severe type of assault & battery with a harsher punishment. An individual who is convicted of aggravated assault & battery can be sentenced to imprisonment in the state prison for up to 5 years or in the house of correction for up to 2.5 years and/or a fine of up to $5,000.00.
