Federal Drug Crimes

Federal drug crimes are governed by the Comprehensive Drug Abuse Prevention and Control Act of 1970.  This statute is commonly referred to as the Controlled Substances Act.  Under the Controlled Substances Act, drugs are broken down into five different schedules based on their similarities.  The Controlled Substances Act is enforced by the Drug Enforcement Agency (DEA).

The most well-known federal drug crime is drug trafficking, which involves transporting large quantities of drugs across state and international borders.  Federal drug crimes may also involve the violation of the Racketeer Influenced and Corrupt Organizations Act (RICO) and federal tax laws.  

Punishment

The punishment for federal drug crimes varies depending on the type and quantity of drugs involved.  The charges are based upon the Federal Sentencing Guidelines.  These guidelines outline a minimum and maximum sentence for each federal drug offense.  An individual can be charged with a drug crime under federal law, state law or both.
