Home invasion is a serious Massachusetts felony that carries a 20–year mandatory minimum sentence and a maximum sentence of life in state prison. Under Massachusetts General Laws Chapter 265 Section 18C, to convict a defendant of home invasion a prosecutor is required to prove beyond a reasonable doubt that the defendant: (1) entered the dwelling place of another person unlawfully; (2) knowing or having reason to know that someone was inside; (3) while armed with a dangerous weapon; and (4) used or threatened to use force on someone in the home.

“Entering the dwelling place of another person unlawfully” generally means without right or consent, putting some part of oneself into a place where a person or persons sleep.

The “knowing or having reason to know that someone was inside” element can be satisfied in a couple of different ways. It may be satisfied where the defendant knew or had some good reason to think that someone was home. It may also be satisfied where the defendant stayed in the home after discovering that a person was home.

“Dangerous weapons” include traditional ones like guns and knives as well as other customarily innocent objects used in dangerous ways. For example, household items like aerosol spray, pens or pencils and lighted cigarettes, though not inherently dangerous, can be considered dangerous weapons when used in certain manners.
