Enticing a Person for Prostitution or Sexual Intercourse


The crime of enticing away a person for prostitution or sexual intercourse is governed by Massachusetts General Laws Chapter 272 Section 2.  In order for an individual to be convicted of enticing away a person for prostitution or sexual intercourse, the Commonwealth must prove beyond a reasonable doubt that:
  • The individual fraudulently or deceitfully enticed a person away from the home of his or her parent or guardian or elsewhere
  • This was done for the purpose of prostitution or for the purpose of unlawful sexual intercourse
An individual may also be convicted of this crime if the Commonwealth proves that he or she aided and assisted in such an abduction for the purpose of unlawful sexual intercourse.  

Punishment

An individual who commits the crime of enticing away a person for prostitution or sexual intercourse can be punished by up to 3 years imprisonment in the state prison or up to 1 year in jail or by a fine of up to $1,000.00.  The individual may also be punished by both a fine and imprisonment in jail.
