Jamaica Plain Drug Lab Criminal Appeals
A chemist at a state drug laboratory in Jamaica Plain breached procedures in the handling of evidence in over 34,000 drug cases. It is believed that at least one chemist contaminated drug evidence, mixed samples from unrelated cases, and manipulated drugs to increase weight, leading to wrongful convictions and incarcerations.
The Jamaica Plain lab did work on drug evidence in cases in Barnstable, Bristol, Essex, Dukes, Nantucket, Norfolk, Plymouth and Suffolk Counties. If you or someone you know has been charged or convicted of a drug offense in one of these counties, he or she may be able to re-open the case with an appeal or a motion for new trial based on the mishandling of key evidence.
In addition to possible reversals of convictions, any individual who was charged with a drug crime in the above-mentioned counties and took a plea offer instead of going to trial may be able to have his or her plea vacated. A plea to a criminal offense cannot be accepted by a judge if the waiver of that person's right to a fair trial was not made knowingly and voluntary. A defendant cannot knowingly waive his rights to a trial if the evidence that the Commonwealth is offering to show has been tampered with or misrepresented. Therefore, if you took a plea deal from the district attorney, based misrepresentations by the Commonwealth regarding the amount or make up of the narcotics you were being charged with, you may be able to vacate that plea.
