Massachusetts Hardship License Lawyer

In Massachusetts, individuals who have had their driver’s license suspended or revoked can apply for a “hardship license.” Commonly referred to as a Work License or Cinderella License, a MA Hardship License permits the holder to operate a motor vehicle for a 12 hour period each day for the purpose of getting to and from work. In order to obtain a Hardship License, an individual must attend a Registry of Motor Vehicles (RMV) hearing. At the RMV hearing, a determination will be made regarding the issuance of a MA Cinderella License. RMV Hardship Licenses are available in Massachusetts to individuals who have had their license revoked and suspended for the following offense types:

  • Operating Under the Influence (OUI) of Alcohol/Drugs
  • Habitual Traffic Offender (HTO)
  • First Offense (24D) Alcohol/Drug Program
  • (94C) Drug Conviction

In order to receive a Hardship License, an applicant must meet certain criteria. The specific criterion that must be met is determined by the type of underlying offense. In MA, each offense category has a criteria checklist to be used by the RMV when making the determination. Yet even if the applicable criteria are met, an applicant is not guaranteed to obtain a Hardship License. The decision to issue a Hardship License is granted only at the reasonable discretion of the RMV based on the specific facts surrounding the case.
