OUI (Operating Under the Influence)
  • 1st Offense: No minimum jail sentence, but up to 2 ½ years in jail, $500-$5,000 fine, License suspension of 180 days (if over age 21)
  • 2nd offense: 30 Days to 2 ½ years in jail, $600-$10,000 fine, license suspension for 2 years
  • 3rd Offense: (Felony) 150 days to 5 years in jail, $1,00-$15,000 fine, license suspension for 8 years
  • 4th Offense: (Felony) 1 to 5 years in jail, $1,500-$25,000 fine, license suspension of 10 years
  • 5th Offense: (Felony) 2 to 5 years in jail, $20,000-$50,000 fine, lifetime license suspension
OUI While Operating After a Suspension for a Previous OUI Offense
  • 1 Year Mandatory Minimum, Maximum Sentence 2 ½ Years
  • Fine of $2,500-$10,000
  • Loss of License for up to 1 year
Operating a Motor Vehicle Under the Influence with a Child 14 or Younger in the Vehicle
  • 1st Offense: 90 Days- 2 ½ Years in jail and a $1,000-$5,000 fine, 1 year license suspension
  • 2nd Offense: 6 Months- 2 ½ years in jail and a $5,000-$10,000 fine, or 3-5 years imprisonment, 3 year license suspension
Vehicular Homicide While Under the Influence
  • Negligently or Recklessly: 2 ½ to 15 years in jail, up to $5,000 in fines
  • Not Negligently or Recklessly: 30 days to 2 ½ years in jail, $300-$3,000 in fines
