of Mind When You
Need It Most.
Massachusetts laws permit the Registry of Motor Vehicles (RMV) to suspend an individual’s license for a variety of reasons. These reasons include refusal to submit to a breathalyzer test, criminal conviction for drug possession or trafficking, excessive traffic law violations, and charges of drunk driving—technically referred to in Massachusetts as “operating under the influence” (OUI) and, in other states, as “driving under the influence” (DUI) and “driving while intoxicated” (DWI). If your Massachusetts driver’s license has been suspended, you may seek to have your license reinstated or to obtain a hardship license by completing an application and attending a Registry hearing. At the Massachusetts law firm of Altman & Altman, LLP, we understand that this process can be confusing and overwhelming, and we are prepared to stand by your side every step of the way.
At a Registry hearing, a representative from the Registry will review your application, along with other required documents. The Registry will then determine if you are eligible for a license reinstatement or MA hardship license because of a legitimate hardship (e.g., inability to get to work or doctors’ appointments via public transportation). You must also show that you will not be a public safety hazard on the road. The Registry, however, has substantial discretion to decide whether or not you return to the road, taking into account factors such as completion of alcohol treatment and education programs, discharge summaries from treatment programs stating your risk of recidivism, whether you have served the minimum suspension period and whether you complied with probation conditions. Given the multitude of factors assessed by the Registry, as well as the intimidating nature of a Registry hearing, it is in your best interest to have a seasoned registry hearing attorney on your side to increase your chances of obtaining a hardship license or license reinstatement.
