Pre-Trial Investigation

This investigation, also known as a pre-file investigation, examines a person who is suspected of committing a crime before charges have been officially filed. Police and other law enforcement agencies may speak to people considered experts, including witnesses, to determine if a crime has been committed, the extent of that crime, the circumstances, and who else was involved.

The police are expected to conduct pre-trial investigations within a reasonable time after a crime has been committed, and must let a prosecutor know that a pre-trial investigation is taking place. However, sometimes an investigation is not announced if the case is clear-cut, such as those involving petty theft, petty assault and endangering traffic. If you suspect you are being investigated for a crime, it’s important to speak with an experienced Greater Boston attorney who can find out if a pre-trial investigation is ongoing. An attorney can help ensure your constitutional rights are respected, and can help prevent an arrest by questioning collected evidence and negotiating with the prosecution on your behalf prior to charges being filed.
