Drug trafficking, perhaps the most well-known drug crime, involves transporting large quantities of drugs across state and international borders.In order to be convicted of Drug Trafficking in Massachusetts, the prosecution has the burden of proving all of the elements of a regular drug possession charge along with the additional element that the accused was in possession of a certain quantity of drugs.

Racketeer Influenced and Corrupt Organizations Act (RICO) Charges

Federal drug crimes may also involve the violation of the Racketeer Influenced and Corrupt Organizations Act (RICO).RICO is a federal law that provides for increased sentences for acts performed as part of a criminal organization.Individuals may be prosecuted under RICO for crimes such as extortion, blackmail, racketeering, bribery, money laundering, embezzlement, commission of murder-for-hire and other organized criminal behavior.

Punishment

The punishment for federal drug crimes varies depending on the type and quantity of drugs involved.The charges are based upon the Federal Sentencing Guidelines.These guidelines outline a minimum and maximum sentence for each federal drug offense.An individual can be charged with a drug crime under federal law, state law or both.
